A "slippery slope argument" is a type of argument in which a first step is taken and a series of inextricable consequences follow, ultimately leading to a disastrous outcome. Many textbooks on informal logic and critical thinking treat the slippery slope argument as a fallacy. Walton argues that used correctly in some cases, they can be a reasonable type of argument to shift a burden of proof in a critical discussion, while in other cases they are used incorrectly. Walton identifies (...) and analyzes four types of slippery slope argument. Walton presents guidelines that show how each type of slippery slope argument can be used correctly or incorrectly, using over fifty case studies of argumentation on controversial issues. This chapter proposes a dialectical approach to legal interpretation, consisting of three dimensions: a formalization of the canons of interpretation in terms of argumentation schemes; a dialectical classification of interpretive schemes; and a logical and computational model for comparing the arguments pro and contra an interpretation. The traditional interpretive maxims or canons used in both common and civil law are translated into defeasible patterns of arguments, which can be evaluated through sets of corresponding critical questions. These interpretive argumentation schemes are (...) classified in general categories and a distinction is drawn between schemes supporting and rebutting an interpretation. This framework allows conceiving statutory interpretation as a dialectical procedure consisting in weighing arguments pro and contra an interpretation. Argumentation, which can be abstractly defined as the interaction of different arguments for and against some conclusion, is an important skill to learn for everyday life, law, science, politics and business. The best way to learn it is to try it out on real instances of arguments found in everyday conversational exchanges and legal argumentation. In this volume, Douglas Yoder uses the tools of modern and postmodern philosophy and biblical criticism to elucidate the epistemology of the Tanakh, the collection of writings that comprise the Hebrew Bible. Despite the conceptual sophistication of the Tanakh, its epistemology has been overlooked in both religious and secular hermeneutics. The concept of revelation, the genre of apocalypse, and critiques of ideology and theory are all found within or derive from epistemic texts of the Tanakh. Yoder examines how philosophers (...) such as Spinoza, Hume, and Kant interacted with such matters. He also explores how the motifs of writing, reading, interpretation, image, and animals, topics that figure prominently in the work of Derrida, Foucault, and Nietzsche, appear also in the Tanakh. Recent work in artificial intelligence has increasingly turned to argumentation as a rich, interdisciplinary area of research that can provide new methods related to evidence and reasoning in the area of law. Douglas Walton provides an introduction to basic concepts, tools and methods in argumentation theory and artificial intelligence as applied to the analysis and evaluation of witness testimony. He shows how witness testimony is by its nature inherently fallible and sometimes subject to disastrous failures. At the same time (...) such testimony can provide evidence that is not only necessary but inherently reasonable for logically guiding legal experts to accept or reject a claim. Walton shows how to overcome the traditional disdain for witness testimony as a type of evidence shown by logical positivists, and the views of trial sceptics who doubt that trial rules deal with witness testimony in a way that yields a rational decision-making process. On September 1, 2023, Texas made important revisions to it its decades‐old statute granting legal safe harbor immunity to physicians who withhold or withdraw life‐sustaining treatment over the objection of critically ill patients’ surrogate decision‐makers. However, lawmakers left untouched glaring flaws in a key safeguard for patients—the transfer option. The transfer option is ethically important because, when no hospital is willing to accept the patient in transfer, that fact is taken as strong evidence that the surrogates’ treatment requests fall outside (...) accepted medical practice. But there are serious shortcomings in how the transfer option is carried out in Texas and many other states, which undermines the ethical usefulness of the process. We identify these shortcomings and recommend revisions to state statutes and professional guidelines to overcome them. (shrink)

Wigmore thought that there was a science of proof underlying legal reasoning that could be displayed in any given case as a graphic sequence of argumentation from the evidence in the case leading to the ultimate probandum. Argumentation technology has now vindicated this approach by providing useful qualitative methods that can be applied to identifying, analyzing, and evaluating the pro and con arguments put forward by both sides in a trial. In this chapter, it is shown how to apply argumentation (...) schemes, such as argument from witness testimony, using argument diagrams applied to typical sequences of evidence-based legal reasoning in which there is a successive refinement of arguments displayed as the evidence comes into a case. It is shown how argument from applying rules to cases, teleological, argument from expert witness testimony, and abductive reasoning are centrally important for this purpose. (shrink)

A recent French reform has revised the legal definition of the corporation. In essence, the law stipulates that the corporation must be run with due regard to the social and environmental impacts of its activity. It also introduces the notion of raison d’être and affords the possibility for any corporation to assign social or environmental purposes to itself, defined in its by-laws. This reform is similar to recent reforms in the UK and the US, but is based on an original (...) and distinctive theoretical argument. The aim of our article is to analyze the fundamental tenets of this reform and their implications for the theory of the corporation. It shows that the new law is based on a new positive definition of the enterprise as not only an economic organization or a productive entity, but more fundamentally a space for innovative collective action. We argue that this view of the enterprise challenges our conceptualization of the corporation in two important ways. First, it shows that the traditional theories overlook the activities of the enterprise and their related impacts, and that the corporation is not necessarily the appropriate legal vehicle for the innovative enterprise. Second, it suggests that the stipulation of the enterprise’s purpose or raison d’être in the corporate by-laws can provide new promising legal foundations for corporate responsibility. (shrink)

Social dilemmas occur when the pursuit of self-interest by individuals in a group leads to less than optimal collective outcomes for everyone in the group. A critical assumption in the human sciences is that people's choices in such dilemmas are individualistic, selfish, and rational. Hence, cooperation in the support of group welfare will only occur if there are selfish incentives that convert the social dilemma into a nondilemma. In recent years, inclusive fitness theories have lent weight to such traditional views (...) of rational selfishness on Darwinian grounds. To show that cooperation is based on selfish incentives, however, one must provide evidence that people donotcooperatewithoutsuch incentives. In a series of experimental social dilemmas, subjects were instructed to make single, anonymous choices about whether or not to contribute money for a shared “bonus” that would be provided only if enough other people in the group also contributed their money. Noncontributors cited selfish reasons for their choices; contributors did not. If people are allowed to engage in discussion, they will contribute resources at high rates, frequently on irrational grounds, to promote group welfare. These findings are consistent with previous research on ingroup biasing effects that cannot be explained by “economic man” or “selfish gene” theories. An alternative explanation is that sociality was a primary factor shaping the evolution ofHomo sapiens. The cognitive and affective mechanisms underlying such choices evolved under selection pressures on small groups for developing and maintaining group membership and for predicting and controlling the behavior of other group members. This sociality hypothesis organizes previously inexplicable and disparate phenomena in a Darwinian framework and makes novel predictions about human choice. (shrink)

A growing interest in and concern about the adequacy and fairness of modern peer-review practices in publication and funding are apparent across a wide range of scientific disciplines. Although questions about reliability, accountability, reviewer bias, and competence have been raised, there has been very little direct research on these variables.The present investigation was an attempt to study the peer-review process directly, in the natural setting of actual journal referee evaluations of submitted manuscripts. As test materials we selected 12 already published (...) research articles by investigators from prestigious and highly productive American psychology departments, one article from each of 12 highly regarded and widely read American psychology journals with high rejection rates (80%) and nonblind refereeing practices.With fictitious names and institutions substituted for the original ones (e.g., Tri-Valley Center for Human Potential), the altered manuscripts were formally resubmitted to the journals that had originally refereed and published them 18 to 32 months earlier. Of the sample of 38 editors and reviewers, only three (8%) detected the resubmissions. This result allowed nine of the 12 articles to continue through the review process to receive an actual evaluation: eight of the nine were rejected. Sixteen of the 18 referees (89%) recommended against publication and the editors concurred. The grounds for rejection were in many cases described as “serious methodological flaws.” A number of possible interpretations of these data are reviewed and evaluated. (shrink)

It was written in three to four months and after some editorial changes the manuscript was sent to the printer in October 1888, and published in January 1889. Nietzsche does not mince words regarding the aim of the book. In the Foreword to the text he claims that it is a "grand declaration of war," not on the idols of the age, but "eternal idols," those he (...) considers to be "the most believed in."1 In Nietzsche's view, there are "more idols in the world than there are realities" and he wants to "sound out idols" as much with a hammer "as with a tuning fork" so that their harmful influence may be avoided in the future. In this paper, we consider climate change as a systemic respiratory crisis, and explore how breath can function as a mode of witnessing climate catastrophe. We build on feminist environmental humanities methodologies of embodied attunement to advance a more-than-human witnessing of climate change. We suggest that a feminist “conspiratorial” witnessing of breath(lessness) can afford an embodied, situated, empathetic and systemic mode of witnessing. In this approach, the witness (e.g., “the human”) is part of what is witnessed (the climate crisis). As (...) such, breathing climate catastrophe can reveal the intimate, visceral and personal violences of global climate change, and develop empathetic approaches to climate injustice. Nevertheless, as breath’s social and multispecies differentiation reveals, no-one can witness the entirety of climate catastrophe with their own bodies. We thus advocate for collective, more-than-individual modes of knowing, such as science, art and critical analysis, to augment our own sensorial experiences of witness. (shrink)

The name ‘Chloe’ appears four times in Horace'sOdes, once in Book 1 and three times in Book 3. Whether the ‘Chloes’ represent a woman or women from Horace's real life is probably not something we could know. Furthermore, there is no obvious reason to assume that all the ‘Chloes’ are the same person. However, there is likewise no obvious reasonnotto read the odes in which the name ‘Chloe’ appears, as some scholars have done, as referring to the same woman, fictional (...) or otherwise. This article argues both that ‘Chloe’ is a consistent character in theOdesand that the portrayal of Chloe is not only connected across odes but also sequential. Taking the poems in order, we see Chloe grow up from a girl who is inexperienced in the world of men to a mature mistress who plays the dominant role in her love affairs. (shrink)

This longitudinal study was in the main concerned with the relationship between developmental maturity (in the physiological sense) and attitude to school science, among a group of secondry school children. The sample consisted of 269 boys and girls in a midland secondary school. They were administered a non?verbal intelligence test, a Piagetian conceptual development test, and an attitude to school science scale, in the first and second years. In the fifth year they were again administered the attitude to school science (...) scale. On the basis of the onset of menstruation, the girls were divided into early, normal and late developers. The results showed that between the second and fifth years, attitudes to school science became more negative??this applied to both boys and girls, but it was more marked in the case of the girls. It was also found that in the first and second years of the study, early maturing girls showed significantly more negative attitudes to school science, but that by the fifth year, early and late maturing girls were showing equally negative attitudes to this subject. Although the normal developers shared in the general decline in attitudes between the second and fifth years, their reactions to school science were less unfavourable throughout. The implications of these findings are discussed at length within the framework of current reserch and theory in this area. (shrink)

ABSTRACT In this wide-ranging interview Professor Douglas V. Porpora discusses a number of issues. First, how he became a Critical Realist through his early work on the concept of structure. Second, drawing on his Reconstructing Sociology, his take on the current state of American sociology. This leads to discussion of the broader range of his work as part of Margaret Archer’s various Centre for Social Ontology projects, and on moral-macro reasoning and the concept of truth in political discourse.

In this paper I argue that composer John Cage’s so-called ‘silent piece’, 4’33”, is music. I first defend it against the charge that it does not involve the organization of sound, which has been taken to be a necessary feature of music. I then argue that 4’33” satisfies the only other condition that must be met for it to be music: it bears the right socio-historical connections to its predecessors within its tradition (Western art music). I argue further that one (...) cannot understand the organized sound condition and the socio-historical condition separately and that understanding their interaction has theoretical benefits—not least of which is providing a groundwork for a more culturally inclusive philosophy of music. Finally, I consider a number of outstanding questions concerning the content of the organized sound condition for Western art music in the wake of 4’33”. (shrink)

A review of the literature indicates that linear models are frequently used in situations in which decisions are made on the basis of multiple codable inputs. These models are sometimes used normatively to aid the decision maker, as a contrast with the decision maker in the clinical vs statistical controversy, to represent the decision maker "paramorphically" and to "bootstrap" the decision maker by replacing him with his representation. Examination of the contexts in which linear models have been successfully employed indicates (...) that the contexts have the following structural characteristics in common: each input variable has a conditionally monotone relationship with the output; there is error of measurement; and deviations from optimal weighting do not make much practical difference. These characteristics ensure the success of linear models, which are so appropriate in such contexts that random linear models may perform quite well. 4 examples involving the prediction of such codable output variables as GPA and psychiatric diagnosis are analyzed in detail. In all 4 examples, random linear models yield predictions that are superior to those of human judges. (shrink)

Dawes points out the fallacy in many commonly held beliefs in therapy and takes issue with many current treatment methods.

The mesostriatal dopamine system is prominently implicated in model-free reinforcement learning, with fMRI BOLD signals in ventral striatum notably covarying with model-free prediction errors. However, latent learning and devaluation studies show that behavior also shows hallmarks of model-based planning, and the interaction between model-based and model-free values, prediction errors, and preferences is underexplored. We designed a multistep decision task in which model-based and model-free influences on human choice behavior could be distinguished. By showing that choices reflected both influences we could (...) then test the purity of the ventral striatal BOLD signal as a model-free report. Contrary to expectations, the signal reflected both model-free and model-based predictions in proportions matching those that best explained choice behavior. These results challenge the notion of a separate model-free learner and suggest a more integrated computational architecture for high-level human decision-making. (shrink)
